What’s the difference between community property and separate property?

Community property arises from the time of the marriage, so everything that you have earned and that your spouse has earned during the marriage is considered community property. If you two go out and buy a home together during the marriage, that home is going to be community property. And again I'm speaking very generally, but anything that either of you had before marriage or that has been given to you by gift or inheritance is separate property. Sometimes personal injury awards are separate property unless they are for lost wages.
